These booking terms and conditions apply to all tours, treks, and activities offered by our company. By booking with us, you agree to the terms outlined below, which govern your rights and responsibilities during the planning, payment, and participation in any tour or trekking experience. Please read these terms carefully before confirming your reservation. If you have any questions or require clarification, feel free to contact us. The Booking Terms and Conditions define the contractual relationship between Himalayan Leisure, Inc. (“the Company”) and the person booking any services provided by the company (the Client). By making a booking, the Client agrees to comply with the following conditions:
1. Booking Confirmation
Upon booking a tour with Himalayan Leisure, Inc., your reservation will be confirmed only after we receive a deposit or the full payment as specified in your booking details or as agreed with the company. A confirmation email will be sent to you outlining the finalized itinerary, package inclusions, and other relevant information. We recommend reviewing the details carefully to ensure all elements of your tour meet your expectations.
2. Payment Policy
To secure your booking, a deposit is required at the time of confirmation. The amount of the deposit may vary depending on the specific tour or package booked. The deposit is refundable up to the period specified on the tour details page. payment of the remaining balance is required no later than 21 days before the start of your tour. If full payment is not received by the due date, Himalayan Leisure, Inc. reserves the right to cancel the booking, and the deposit will be forfeited. The due amount can be paid on your arrival as agreed with the company.
For bookings made less than 14 days before the tour's start date, full payment is required at the time of booking unless agreed differently with the company.
3. Cancellation Policy
Himalayan Leisure, Inc. offers free cancellations on every tour up to a specified period before the arrival date. Our cancellation policy is as follows:
We recommend obtaining travel insurance that covers cancellations to safeguard against unforeseen circumstances.
4. Tour Postponement Policy
We understand that plans may change, and in certain cases, Himalayan Leisure, Inc. offers a free option to postpone your tour. However, any differences in tour fees or costs that have already been incurred (such as permits, flight tickets, or other non-refundable expenses) must be paid by the client.
5. Amendments and Changes
If you wish to amend your booking (such as changing dates, altering the itinerary, or upgrading accommodations), you must submit your request in writing. Himalayan Leisure, Inc. will make every effort to accommodate changes, but they are subject to availability. Any additional costs incurred as a result of the amendment will be passed on to the client.
Please note that certain changes, such as adjusting the itinerary, may require advance notice due to the nature of travel in remote areas. Some amendments may not be possible within 14 days of the tour's start date.
6. Force Majeure
In the event of circumstances beyond our control (such as natural disasters, political instability, pandemics, or extreme weather conditions), Himalayan Leisure, Inc. reserves the right to cancel or modify your booking. In such cases, we will do our best to offer an alternative tour or postpone your booking. If neither option is feasible, we will refund any recoverable costs. However, please note that non-recoverable costs, such as permits, flights, or pre-booked accommodation, may not be refundable.
Clients are encouraged to have travel insurance that includes coverage for unforeseen events or force majeure situations.
7. Travel Insurance
Travel insurance is highly recommended for all clients participating in our tours. Your insurance must cover trekking, climbing (if applicable), medical evacuation, accidents, and other potential risks associated with adventure travel. Himalayan Leisure, Inc. is not responsible for any costs related to injuries, illnesses, or accidents that occur during the tour.
Before embarking on your tour, you may be asked to provide proof of your insurance in some cases.
8. Health and Fitness
Participation in trekking and adventure travel requires a certain level of physical fitness. It is the responsibility of each client to ensure they are physically and mentally prepared for the activities outlined in their itinerary. Clients with pre-existing medical conditions should consult a doctor before booking a tour.
Himalayan Leisure, Inc. reserves the right to refuse participation to any client who, in our opinion, does not meet the required fitness levels or whose participation may endanger themselves or others.
9. Responsibility and Liability
Himalayan Leisure, Inc. assumes no responsibility for any loss, damage, or injury to personal property or for any loss of life or injury during the tour. Clients participate in activities at their own risk.
We encourage all participants to follow the safety instructions provided by their guides and to be mindful of their own physical limits. The company will not be liable for any accidents or incidents that occur as a result of reckless behavior, failure to follow guide instructions, or engagement in activities outside the scope of the itinerary.
10. Special Requests
We strive to accommodate special requests such as dietary preferences, rooming requests, or specific activity interests. Please communicate these requests at the time of booking. While we will make every effort to meet these needs, Himalayan Leisure, Inc. cannot guarantee that all requests will be fulfilled, particularly in remote areas where resources may be limited.
11. Refunds
No refunds will be provided for any unused services once the tour has commenced. This includes, but is not limited to, unused accommodations, meals, transportation, staff services or activities that the client chooses to forego during the trip. Refunds are only provided in accordance with the cancellation policy outlined above. It may take up to 30 days to process the refunds and it will be made to only original payment methods or as per the agreement with the client.
12. Compliance with Local Laws and Customs
Clients are expected to comply with all local laws, customs, and regulations during the tour. Himalayan Leisure, Inc. places great importance on respecting the local culture, environment, and communities. Clients who engage in unlawful activities or disrespectful behavior may be removed from the tour without a refund.
13. Dispute Resolution
In the event of a dispute arising from the terms and conditions of this agreement or from the operation of the tour itself, the dispute shall be resolved in accordance with the laws of Nepal. Both parties agree to resolve the dispute through amicable negotiations. If a resolution cannot be reached, the matter may be escalated to the appropriate legal jurisdiction.
